RackTwinks. ("RackTwinks."), ("Us"), ("We") agrees to furnish services to the Subscriber ("Customer"), ("Client"), and ("You"). By using our services, you agree to these Terms of Service ("TOS"), our Acceptable Use Policy ("AUP"), and our Refund Policy.

All provisions of this contract are subject to change from time to time at RackTwinks.'s discretion. The customer understands that a change to RackTwinks.'s TOS shall not be grounds for early contract termination or non-payment.

Services may not be used without agreeing to the Terms. The Terms are accepted by the customer and RackTwinks. whenever Services are ordered or paid for by the customer. The Terms are maintained independently of any other agreement between RackTwinks. and the customer. Unless otherwise agreed in writing with RackTwinks., any secondary agreements between RackTwinks. and the customer will always include, at a minimum, the terms outlined here. If a secondary agreement between RackTwinks. and the customer contradicts any attribute of Terms as outlined here, the secondary agreement shall take precedence.

Account Eligibility

By registering for or using our services, you represent and warrant that:

• You are eighteen (18) years of age or older. The Services are intended solely for Users who are eighteen (18) years of age or older. Any registration, use of, or access to the Services by anyone under eighteen (18) is unauthorized and is a violation of this Agreement. A parent or legal guardian may create an account on behalf of a minor, in which case the parent or legal guardian is responsible for all activities conducted through the account and agrees to these Terms. However, some services remain restricted to users 18 or older, regardless of parental consent.

• You will provide accurate, up-to-date, truthful, current, and complete information on your registration forms, including an email address that is different from the domain you are signing up under. We will use this information to contact you about any issues or for verification. Providing false contact information of any kind may result in the termination of your account.

• You are fully responsible for all use of your account and for any actions that take place through your account. It is your responsibility to maintain the confidentiality of your password and other information related to the security of your account. Any dedicated IP order in addition to those provided with a hosting package may be subject to IP justification. IP justification practices are subject to change to remain in compliance with the policies of the American Registry for Internet Numbers (ARIN). We reserve the right to deny any dedicated IP request based on insufficient justification or current IP utilization.

   

Identity Verification Policy

To ensure the security of our platform and prevent fraudulent activity, RackTwinks. reserves the right to request customers to complete Know Your Customer (KYC) verification at any time. The KYC process, conducted through Stripe Identity, requires customers to submit a government-issued photo ID and a selfie for identity verification.

Only LLC members are authorized to review the submitted KYC information; regular staff do not have access. Additionally, all KYC data is immediately redacted after review is completed to ensure customer privacy.

Failure to complete the KYC process within the requested timeframe may result in account suspension or termination. Customers who choose not to comply may request a refund, which will be issued minus any transaction fees incurred at the time of purchase. By using our services, you agree to this policy as part of our Terms of Service.

Services Provided

RackTwinks. offers a variety of services, including:

1. Phone Numbers

Our phone number services are provided as a tool for communication. You are solely responsible for all usage and must comply with all applicable laws, including but not limited to, the Telephone Consumer Protection Act (TCPA) and the Telemarketing Sales Rule (TSR). Any illegal use, including unsolicited robocalls, caller ID spoofing, or harassment, is strictly prohibited and will result in immediate termination of your service.

2. Premium and Limited-Time Offer VPS

We offer various Virtual Private Server (VPS) plans, including standard Premium plans and special Limited-Time Offer VPS plans. While our VPS services are robust, you are responsible for:

• Data Security: Backing up your data to an external location. We are not liable for any data loss, and while we strive for uptime, we cannot guarantee against unforeseen events.

• Compliance: Ensuring all content and activities on your VPS comply with our AUP and all applicable laws. Any illegal use, such as hosting hacking tools, cryptocurrency miners, or spamming tools, is strictly forbidden.

• Fair Usage: Our VPS services run on shared resources. You must ensure your activities do not negatively impact other customers. We reserve the right to suspend any service that is causing excessive resource usage or negatively affecting other users.

General Terms of Service

• Security: You are responsible for ensuring your services are suitably secured with unique and strong passwords. We are not responsible for any data loss resulting from your lack of security.

• Payments: You are responsible for all payments. Any unpaid invoices will result in the service for the said invoice being suspended, with eventual termination and deletion of all data if left unpaid. Any overpayments due to incorrect PayPal subscriptions are non-refundable. These payments will be added to the customer’s account as a credit to be used on future invoices.

   

• Reselling: The resale of any shared services or part thereof is strictly forbidden. Any user found to be reselling any services hosted on our slots will be immediately terminated with no refund given. VPS, dedicated servers, colocation, and web hosting may be resold.

• Fair Usage: While we may offer unmetered bandwidth or storage, this is not without restriction. You must not abuse our shared resources. We reserve the right to stop or terminate any services that negatively affect other customers.

• Support: Please treat staff with respect at all times. In return, we will treat customers with respect. Any customer being excessively rude will risk being banned from RackTwinks.

• Data Back-up & Recovery: The customer is responsible for the independent backup of data stored on RackTwinks.’s servers; unless the customer has arranged for services that include backup services, in which case data backup will be performed under the terms of the specific data backup plan chosen by the customer. RackTwinks. shall never be held liable for failure to recover data in the event of any sort of failure and shall never be held accountable financially or otherwise for loss of data.

• Free Trials: Free trials are provided as is and RackTwinks. shall not be held liable for any damages that may occur from free trials.

• User Content: You are solely responsible for any and all User Content and any transactions or other activities conducted on or through User Websites. By posting or distributing User Content on or through the Services, you represent and warrant to RackTwinks. that (i) you have all the necessary rights to post or distribute such User Content, and (ii) your posting or distribution of such User Content does not infringe or violate the rights of any third party. RackTwinks. does not monitor User Content, but may take corrective action, including removal or suspension, at its sole discretion if a violation occurs.

Affiliate Program

RackTwinks. operates an affiliate program whereby clients can refer others to RackTwinks. in return for credit. The base commission percentage is 12% and is recurring so long the client still has that service. Upgrades and downgrades will be automatically adjusted at the next payout. To prevent fraud and abuse, we have implemented a 14-day wait period between the order being processed and the commission being paid to your account.

• Withdrawals from the affiliate program will be for RackTwinks. account credit.

• We will not use PayPal, crypto, bank transfers, etc., to pay or exchange the RackTwinks. account credit.

• All promotional, review, and discount sites cannot be used in conjunction with our affiliate system.

• When using your affiliate link, it must not be masked or behind any URL shortener.

• At any point, we reserve the right to refuse an affiliate payout.

• Any abuse of the affiliate system will lead to the closure of your account and your affiliate earnings being revoked.

• Certain products, such as dedicated servers or VPSs, do not have an affiliate payout. These products may vary, and RackTwinks. reserves the right to modify the affiliate system at any time without warning.

• Spamming affiliate links on any platform can/may result in the termination of your affiliate link and/or account.

• RackTwinks. reserves the right to remove any commission credits at any time.

Forbidden and Illegal Use

RackTwinks. services may not be used for illegal purposes or in support of illegal activities. RackTwinks. reserves the right to cooperate with legal authorities and/or injured third parties to investigate any suspected crime or civil wrongdoing.

• Unauthorized Access: Use of the RackTwinks. service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of RackTwinks. or another entity’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending RackTwinks. account is subject to immediate termination and further investigation.

• Prohibited Tools/Programs: The following are prohibited on any RackTwinks. plan: hacking tools, spamming tools, phishing, pornography, cryptocurrency miners, or any malicious content that could reflect poorly on RackTwinks.

Cancellations and Refunds

• Cancellations: You may cancel your service at any point in time. To cancel a service, a cancellation request must be made from the Customer Portal. We offer two options; immediate cancellation and cancel at the end of the billing period. If immediate cancellation is selected, the slot will be terminated and wiped shortly after the request. If immediate cancellation was selected by mistake, we are unable to guarantee that any data will be recoverable. If cancellation at the end of the billing period is selected, the slot will be terminated and wiped at the end of the billing period. It is the responsibility of the customer to ensure that all active PayPal and Stripe recurring payments are canceled.

• Refunds and Disputes: Please refer to our Refund Policy for more information.

• Chargebacks and PayPal Disputes: When opening a service with us, customers agree to contact us first regarding any issues. The use of a PayPal dispute or a chargeback to forcibly revoke funding from us is considered a violation of our TOS. Any customers who commit either of these actions will be blacklisted from using any services with us in the future and will result in the instant termination of your service.

Dispute Resolution

Binding Arbitration: Any dispute shall be determined by binding arbitration in Portland, OR. You are waiving your right to participate in a class action lawsuit. You have the right to opt out within thirty-one (31) days of sign-up by emailing arb@twnk.tech with your notice.

Limitation of Liability and Disclaimer

• Limitation of Liability: RackTwinks. is not liable for any data loss, disruption of information, or unauthorized access to our systems. We are not responsible for any financial or other damages due to service interruptions.

• Disclaimer of Warranties: Services provided by RackTwinks. are on an “as is, as available” basis. We specifically disclaim any other warranty, express or implied, including any warranty of merchantability or fitness for a particular purpose. In no event shall RackTwinks. be liable for any consequential, indirect, special, or incidental damages, even if RackTwinks. has been advised by the customer of the possibility of such potential loss or damage. If RackTwinks.’s service to the customer is disrupted or malfunctions for any reason, RackTwinks. shall not be responsible for any losses of income due to disruption of service during the period of disruption or malfunction.
