This Acceptable Use Policy (“AUP”) governs your use of RackTwinks. services and is incorporated by reference into our Terms of Service. By using our services, you agree to comply with this policy and all applicable laws. RackTwinks. may modify this AUP at any time without notice.
1. General Use
Our services are to be used for lawful purposes only. You are responsible for the activities of your agents, representatives, and end-users (“Users”) and must ensure they abide by this AUP. You shall not use our services for activities which, in our sole discretion, are illegal, offensive, abusive, or that interfere with or adversely affect the services or other users. We reserve the right to suspend or terminate services for any violation of this policy, with or without notice, and with no refund.
2. Telephone and Calling Services
When using our phone number and calling services, you must comply with all applicable laws and regulations. This includes, but is not limited to, the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and all state-specific laws related to telemarketing and automated calls.
Prohibited Actions:

Illegal Robocalls and Spam: You are strictly forbidden from making illegal robocalls or sending unsolicited telemarketing messages, especially to numbers on the National Do Not Call Registry.

Misleading Information: Do not use our services to transmit fraudulent, deceptive, or misleading information, including “spoofing” a caller ID.

Harassment: Do not use our services to harass, stalk, or threaten any person.

Privacy Violations: You are responsible for obtaining proper consent from individuals before making calls or sending messages to them. Do not transmit, distribute, or store any information that infringes on a person’s privacy rights.
Violations of these policies may result in immediate suspension or termination of your account. We will cooperate with legal authorities and third parties in any investigation of alleged violations.
3. Prohibited Content and Materials
We have a zero-tolerance policy for the following types of content and activities. Any account found in violation will be immediately suspended or terminated without a refund.

Child Sexual Abuse Material (CSAM): Any content that depicts, promotes, or is related to the sexual abuse of minors is strictly forbidden. We will report any such material to the appropriate law enforcement agencies.

Intellectual Property Infringement: You may not use our services to infringe on another party’s intellectual property rights, including unauthorized copying or distribution of copyrighted material (movies, music, books, software) or selling counterfeit merchandise.

Adult Content: We have a zero-tolerance policy for adult content, including any media containing nudity, partial nudity, or other content of an adult nature. This does not apply to fictional nudity.

Illegal or Fraudulent Activities: Any activity related to hacking, phishing, spamming, scamming, identity theft, fraud, or the promotion of illegal activities is strictly prohibited.

Harmful Content: You may not host or distribute content that is obscene, defamatory, threatening, or promotes hate speech.

Bruteforce Programs/Scripts/Applications

Mail Bombers/Spam Scripts

File Dump/Mirror Scripts (similar to Rapidshare)

Sale of any controlled substance without prior proof of appropriate permit(s)

Lottery/Gambling Sites without prior proof of appropriate permit(s)

Hacker-focused sites/archives/programs

Forums and websites that distribute or link to warez/pirated/illegal content

Fraudulent Sites (including, but not limited to, sites listed at aa419.org & escrow-fraud.com)

Mailer Pro
-
Broadcast or Streaming of Live Sporting Events (UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc.)

Tell A Friend Scripts

Bitcoin or other cryptocurrency Miners (unless prior permission was granted)

PayDay Loan Sites (including any site related to PayDay loans, PayDay loan affiliate programs, etc.)
5. Spam Policy
We have a zero-tolerance stance against spam—including unsolicited emails and bulk emailing. Purchased lists and “safe lists” are also considered spam. Any user who sends spam will have their account terminated immediately.

If your account leads to our IP space being blacklisted, your service may be immediately suspended or terminated.

We reserve the right to charge a cleanup fee or any charges incurred for blacklist removal at our sole discretion.
6. AUP Violations
Upon violating this AUP, your services may be terminated with or without notice. Refunds are not issued for any AUP violations. If applicable, violations will be reported to the appropriate law enforcement agency.
If you fail to respond to an email from our abuse department within forty-eight (48) hours, or as otherwise specified, it may result in the suspension or termination of your services. All abuse issues must be handled via email or trouble ticket.
